As promised, we have re-opened the Art Contest!

Meagan had a great idea for a theme...

We thought it was a great idea, so we decided to run with it!

(Apologies to those of you who had something from the previous contest that you might have wanted to use -- hopefully you guys are cool with this!)

So anyways, make sure you check out the official rules and post your awesome and not-so-awesome art! The prize is pretty awesome if I do say so myself!

Except isn't this particular example ruled out by rule 8 of the contest???

It might help to be clear on this from the start so people don't get started off on the wrong foot... or hoof, in my case!

I was also confused by rule 8.

I'm not sure if fair use guidelines allow characters or not.

Here's the deal...

The example doesn't necessarily break rule 8 since rule 8 just requires not having anything infringing and that you have all necessary rights, consents, or permissions -- which wouldn't be the case if it's "fair use" because if it's "fair use" then no rights/consents are necessary.

Just use your judgment. I don't anticipate that we'll need to worry about the issue much more considering the respectable level of common sense and maturity we enjoy on this site!

Not necessarily? The example reads like it was drafted as an example of what rule 8 says not to do!

It is also not correct to say that "fair use" clears the decks on rights/consents, as fair use only applies to the copyright aspect of rule 8, not any trademarks that might be involved.

But to get to the heart of your claim -- I am having a hard time identifying which "fair use" rationale you are thinking of that would cover "entering an online art contest with commercial prizes"...
